    Collecting information through automated means allows us to collect statistics about the usage and effectiveness of our Sites, personalize your experience on our Sites, and tailor our interactions with you.     • From other third parties, including, advertisers, data partners, marketing partners and publicly available sources such as social networks.

      • When you, or someone on your behalf, provides information to us to:

        • Establish or maintain an account;

        • Apply for employment at Cycle Gear;

  • We do not, and will not, sell any of your personal information and/or data to any third party providers. Should such a sale or transfer occur, we will require that the transferee use personal information you have provided in a manner consistent with our privacy policy and the applicable legal framework whenever possible.

    • We may share your personal data; where such disclosure is necessary for compliance with a legal obligation to which we are subject, to enforce our Terms of Service, this Policy, or other contracts with you, including investigation of potential violations thereof; to respond to claims that any content violates the rights of third parties; to respond to your requests for customer service; and/or to protect the rights, property or personal safety of Cycle Gear, our agents and affiliates, its users and/or the public. This includes exchanging information with other companies and organizations for fraud protection, spam/malware prevention, or in order to protect your vital interests or the vital interests of another natural person.

    We may disclose your personal data to our insurers and professional advisers as reasonably necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, obtaining professional advice, or the establishment, exercise or defense of legal claims, whether in court proceedings or other legal proceedings. If you would prefer not to have your name and address shared, please send an email to privacy@cyclegear-direct.com with “OPT-OUT” in the subject line and we will begin to put measures in place to not share your information. By doing so, you acknowledge that you may not be able to interact with areas of our site and depending upon the extent of your request we may no longer be able to fulfill orders for you.

    Charitable Giving

    At Comoto, we believe in giving back to our fellow riders and the community more broadly. From time to time, we post information on our website about charitable organizations we support, which may include links allowing donations. Our posting of information on our website related to charities we support is not a solicitation for donations—whether you donate is completely up to you and in no way affects how we provide our products and services to you. We do not process charitable donations, and information you provide to a charity is subject to its terms of service and privacy policy. In some cases, some information you provide in order make a donation may be shared with us by the charity. Charities that share information in this way are required to notify you of that practice in their privacy policies. We appreciate you keeping our community strong, and welcome any questions about our charitable giving or how you can get involved.

  • International Data Transfers
  • Cycle Gear is a global business based in the United States. We may process your information in, or transfer your information to, the United States, third parties in the United States, or other countries. International transfers of your personal data to will be protected by appropriate safeguards, namely the use of Standard Contractual Clauses adopted or approved by the European Commission. Our customers and the users of our Sites may be located anywhere in the world. The privacy laws in some countries may not provide protections equivalent to those in your country of residence, and your government may or may not deem such privacy protections adequate.

  • Your Email Marketing Choices
  • If you have provided consent or you are an existing customer, we will send you marketing messages via email to keep you up to speed on all things Cycle Gear.

    You can stop receiving marketing messages from us at any time through the following methods:

    • Through your customer account settings within “My Account”

    • By clicking on the ‘unsubscribe’ link in any email communication

    • By contacting one of Geek team members at privacy@cyclegear-direct.com

    Once one of these methods is completed, we will update your profile to ensure that you don’t receive further marketing messages.

    Cycle Gear is made up of a complex web of many inter-connecting services and it may take up to 60 days for all our systems to reflect these updates. We ask for your understanding that during this period you may still get messages from us while your request is being processed.

    Please note that the discontinuation of marketing messages will not stop any service communications such as order updates.

  • Security
  • With respect to security; we have appropriate security measures in place in our physical facilities to protect against the loss, misuse or alteration of information that we have collected from you at our site.

    Sensitive and private data exchange between the Site and its Users happens over a SSL secured communication channel and is encrypted and protected with digital signatures. Our Site is also in compliance with PCI vulnerability standards in order to create as secure of an environment as possible for Users. The importance of security for all PII associated with our Users is of utmost concern to us.

  • Data Retention
  • We will keep your personal data while we are providing our products and services to you. Thereafter, we will keep your personal data for one of these reasons: to respond to any questions, complaints or claims made by you or on your behalf; to show that we treated you fairly; to keep records required by law; for communication with one of our Geek team members, and; to provide support-related reporting and trend analysis.

    We will not retain your data for longer than necessary for the purposes for which it was collected as set out in this privacy notice. In determining data retention periods, we take into consideration local laws, contractual obligations, our reasonable business requirements, and your expectations and requirements. When it is no longer necessary to retain your personal data, we will securely delete or anonymize it.

  • Advertising
  • We participate in online advertising to keep our customers up to speed on product offerings, site promotions, and associated content. Like many companies, we utilize targeted Cycle Gear banners and ads and may display these to you when you are on other websites and apps. We do this using a variety of digital marketing networks and ad exchanges in addition to using a range of advertising technologies like web beacons, pixels, ad tags, cookies, and mobile identifiers, as well as specific services offered by some sites and social networks.

    The banners and ads that you may see displayed will be based on information we hold about you, or your previous use of Cycle Gear Sites. This may include your Cycle Gear search history, the content you read on Cycle Gear or on Cycle Gear banners or ads you have previously clicked on.

  • Cookies, Web Beacons and Other Technologies
  • Like many sites, our Sites employ cookies and web beacons to speed your navigation of the Site, recognize you and your access privileges, and track your Site usage.

    • Cookies are small pieces of information that are stored as text files by your Internet browser on your computer’s hard drive. Most Internet browsers are initially set to accept cookies. You can set your browser to refuse cookies from websites or to remove cookies from your hard drive, but if you do, you will not be able to access or use portions of the site.

    • Web beacons assist in delivering cookies and help us determine whether a web page on the site has been viewed and, if so, how many times. For example, any electronic image on the Sites, such as a product image, can function as a web beacon.

    • Cycle Gear utilizes several Google Analytics products, including remarketing with Google Analytics, Google Display Network Impression Reporting and Google Analytics Demographics and Interest Reporting. Visitors may opt out of these features through Ads Settings, Ad Settings for mobile apps, Google's opt-out browser, or other available methods.

These websites also tell you how to set your browser not to accept cookies and how to remove cookies from your browser. However, in a few cases, some of the features on our Sites may not function as a result.

  • Compliance with Children’s Online Privacy Protection Act
  • Protecting the privacy of the anyone under the age of 13 is especially important. For that reason, we never collect or maintain information on our Sites from those we actually know are under the age of 13, and no part of our Sites are structured to engage anyone under the age of 13.

    If Cycle Gear learns that it possesses information from a child under the age of 13, we delete that information from our systems. If you are a parent or guardian and are aware that your child has provided us with personal information, please contact us so that we will be able to take the necessary actions to delete such data.

  • Cycle Gear or third parties that we have engaged, may collect and store unique identifiers matched to your mobile device in order to deliver customized ads or content while you use our Sites, navigate the internet, or to identify you in a unique manner across devices or browsers. In order to customize these ads or content, we, or third parties, may collect your information, e.g., your email address, or data passively collected from you such as your device identifier or IP address.

    Subject to certain limits under the California Civil Code, if you are a California resident, you have the right to submit certain requests relating to your personal information as outlined below. 

    Categories of personally identifying information that we collect include the following: name, postal address, email address, phone number, and purchase history, including specific items you have purchased; browsing history and search history, including your IP address, and interactions with electronic communications; preference data that you have shared, or that we have derived from your purchase and browsing history. 

    In addition to the above, we may use information for any purpose if the information does not identify you and cannot be combined with other information accessible to us to identify you. 

    We do not sell your personal information to third parties. We may, however, share your personal information with third-party service providers in accordance with the business purposes set out in this Privacy Policy.

    Please note that due to the different requirements of the applicable laws, our response times may vary depending on the specific type(s) of information sought. We respond to all verifiable requests for information as soon as we reasonably can, and no later than legally required. 

    Right to Request Deletion of Your Personal Information

    Upon your request and confirmation of your identity, we will let you know what, if any, personal information we can delete from our records, and we will direct any service providers with whom we shared your personal information also to delete your personal information from their records. There may be circumstances where we (or our service providers) cannot delete your personal information. For example, if we need to: (A) retain your personal information to complete a transaction or provide goods or services; (B) detect security incidents; (C) protect against unlawful activities; (D) identify, debug or repair errors; (E) comply with a legal obligation (for example to comply with warranty return obligations) or (F) to document activities and communications with you, including any specific request related to this policy.     Verification of Requests for Further Information or to Delete Information

    Upon submission of a request for information or a request to delete information, we will take reasonable steps to confirm that the person submitting the request to know or request to delete is the person to whom the information relates, and to prevent unauthorized access or deletion of information. The specific steps taken to verify the identity of the requesting person may vary based on the nature of the request, including the type, sensitivity and value of the information requested, the risk of harm posed by unauthorized access or deletion, the likelihood that fraudulent or malicious actors may seek the information, the robustness of personal information provided to verify your identity, the nature of our business relationship with you, and available technology for verification. 

    We will generally try to avoid requesting additional information from you for the purpose of verification, but we may need to do so if we cannot verify your identity based on the information already maintained by us. If we request additional information to verify your identity, it will be for that purpose only, and will be deleted as soon as practical after processing the request, except as otherwise provided by law. 

    The following generally describes the verification processes we use: 

    • Password Protected Accounts. If you have a password-protected account with us, we may use existing authentication practices to verify your identity, but will require re-authentication before disclosing or deleting data. If we suspect fraudulent or malicious activity relating to your account, we will require further verification (as described below) before complying with a request to know or delete.

    • Verification for Non-Account-holders. If you do not have, or cannot access, a password-protected account with us, we will generally verify your identity as follows:

      • For requests to known categories of personal information, we will verify your identity to a reasonable degree of certainty by matching at least two data points provided by you with reliable data points maintained by us. 

      • For requests to know specific pieces of personal information, we will verify your identity to a reasonably high degree of certainty by matching at least three data points provided by you with reliable data points maintained by us. We will also require a declaration, signed under penalty of perjury, that the person requesting the information is the person whose information is the subject of the request. We will maintain all signed declarations as part of our records. 

      • For requests to delete personal information, we will verify your identity to a reasonable degree or a reasonably high degree of certainty depending on the sensitivity of the personal information and the risk of harm posed by unauthorized deletion. We will act in good faith when determining the appropriate standard to apply.

    • Verification by Authorized Agent. You may designate an authorized agent to make the requests below on your behalf. An authorized agent must submit proof to us that he or she has been authorized by you to act on your behalf, and you will need to verify your identity directly with us through the process described below. 

    If there is no reasonable method by which we can verify your identity, we will state so in response to a request to know or delete personal information, including an explanation of why we have no reasonable method to verify your identity. 

    Right to Non-Discrimination for the Exercise of Your California Privacy Rights

    If you choose to exercise any of the privacy rights conferred by the California Consumer Privacy Act of 2018, you also have the right not to receive discriminatory treatment by us. This means that, consistent with California law, we will not deny providing goods or services to you, charge you different prices or provide a different level or quality of goods and services to you unless those differences are related to the value of your personal information.

    We may change this Privacy Policy from time to time. Should we do so, we will post the changes to this page. We suggest that you periodically consult this Privacy Policy to review any changes.
